Terms of Service
Last updated: 4 September 2026
These terms are between you (the business, club, or organization using Ottakin — “you”) and Ottakin (“we”, “us”). By creating an account you agree to them.
The service
Ottakin provides digital loyalty and membership programs delivered through Apple Wallet and Google Wallet, tools to run events and messages, and analytics about repeat customers and member engagement. Ottakin is in early access and is being actively developed; features may change.
Your account
You are responsible for your account, for anyone you give access to it (staff, executives), and for keeping your credentials secure. You agree the information you provide is accurate.
Your programs and your customers
The rewards, offers, memberships and events you create are yours. The relationship with your customers or members — including honouring rewards and offers — is between you and them. Ottakin is not a party to it and is not responsible for it. You are responsible for using the messaging features fairly and only to reach people who have joined your program.
Acceptable use
Don’t use Ottakin for anything unlawful; don’t send deceptive, harassing or spam messages through it; don’t upload other people’s personal information without a lawful basis; don’t attempt to break, overload, scrape or reverse-engineer the service. We may suspend accounts that do.
Fees
Ottakin is currently free to use during early access. If we introduce charges, we will give you notice first and you can choose whether to continue. Paid plans are billed through Stripe on a recurring basis; you can cancel at any time and cancellation takes effect at the end of the current billing period. We don’t provide refunds for partial periods except where required by law.
Your data
Our handling of data is described in the Privacy Policy. You can export or delete your customer, member and activity data, and close your account, at any time.
Availability and warranties
During early access the service is provided “as is” and “as available”, without warranties of any kind. We aim to keep it running and to give notice of major changes, but we can’t guarantee uninterrupted or error-free service.
Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental or consequential damages. Our total liability for any claim relating to the service is limited to the fees you paid to Ottakin in the three months before the claim, or CA$100 if you have not paid any fees.
Suspension and termination
You can stop using Ottakin and close your account at any time. We may suspend or close an account for a serious or repeated breach of these terms, for non-payment on a paid plan, or if we discontinue the service — in which case we will give you a reasonable chance to export your data.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction.
Changes
We may update these terms. If a change is significant we will notify account holders. Continued use after a change means you accept the updated terms.
